Section 1 Scope

(1) These terms and conditions (hereinafter "terms") apply to all contracts concluded between Djoungol and you as a customer via the online shop at djoungol.com.

(2) Our offer is directed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (section 13 of the German Civil Code, BGB).

(3) The version of these terms valid at the time of your order applies. Deviating terms of the customer do not become part of the contract unless we have expressly agreed to their validity.

Offer and ordering process

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation for you to place an order.

(2) The ordering process in the shop works as follows:

  • You select the desired product (and a variant where applicable) and add it to the basket using the "Add to cart" button.
  • In the basket you can change quantities or remove items. The "Check out" button takes you to the ordering process.
  • You enter your contact details and the delivery address and select the shipping method and the payment method.
  • Before submitting the order you will see an overview of all order data (products, prices, shipping costs, total price, addresses, payment method). You can correct input errors at any time by going back one step in your browser or by changing the entries directly in the relevant fields. You can cancel the ordering process at any time before submitting the order, for example by closing the browser window.
  • By clicking the final order button (labelled for example "Buy now" or "Order with obligation to pay") you submit a binding offer to purchase the goods contained in the basket.

Order confirmation and acceptance

(3) After we receive your order, you will receive an automatically generated email in which we confirm receipt of your order and list its contents (order confirmation). This order confirmation does not yet constitute acceptance of your offer; it merely documents that your order has reached us.

(4) The purchase contract is only concluded once we accept your offer. Acceptance takes place through a separate declaration in text form (for example an order or shipping confirmation by email) or through delivery of the goods. If we do not accept your offer within five days of receiving the order, it is deemed rejected; in that case we will refund any payments already made without undue delay.

(5) If you choose a payment method where payment is initiated during the ordering process (for example credit card, PayPal, Apple Pay or Google Pay, insofar as we offer these payment methods), acceptance may also take place through us initiating the payment or collecting the amount.

(6) We send the order confirmation and the declaration of acceptance to the email address you provided. Please make sure that this address is correct and that emails from us are not blocked by spam filters.

Section 3 Contract language and storage of the contract text

(1) The language available for concluding the contract is German.

(2) We store the contract text (order data and terms) and send you the order data as well as these terms by email. You can view, print or save the terms on this page at any time.

(3) After the order has been completed, the contract text is no longer accessible via the shop for security reasons. If you have created a customer account, you can view your previous orders there.

(4) We have not subscribed to any particular codes of conduct.

Section 4 Prices and shipping costs

(1) All prices stated in the shop are final prices in euros and include the applicable statutory VAT.

(2) Shipping costs are added to the product prices unless free delivery is expressly indicated. Shipping costs depend on the delivery country and are shown to you during the ordering process before you submit the order. Details on shipping costs and free-shipping thresholds can be found on the Shipping and payment page.

(3) We deliver exclusively to the European Union countries listed in section 6. Additional import duties therefore do not apply.

Section 5 Payment

(1) The payment methods displayed during the ordering process are available to you. The payment methods actually offered during the ordering process are decisive.

(2) The purchase price is due on conclusion of the contract, unless otherwise stated by the chosen payment method. When paying by credit card, PayPal, Apple Pay or Google Pay, the payment method is charged on completion of the order or on acceptance of the offer.

(3) For payment methods processed via a payment service provider (for example PayPal or Klarna), that provider's terms of use or general terms apply in addition; these are referred to during the ordering process. For purchase on invoice or instalment payment via Klarna, payment deadlines and terms follow from Klarna's conditions.

(4) We reserve the right to offer individual payment methods only for certain delivery countries or up to certain order values. In the event of late payment, the statutory provisions apply.

Section 6 Delivery, delivery time and partial delivery

(1) We deliver to addresses in Germany, France, Belgium, the Netherlands, Luxembourg and Austria. Delivery to other countries is currently not possible. The list of countries selectable during the ordering process is decisive.

(2) Delivery is by parcel to the delivery address you provided. Collection in person is not possible.

(3) The expected delivery time is stated on the relevant product page or on the Shipping and payment page. Unless stated otherwise there, the delivery time is approximately 2 to 4 working days within Germany and approximately 3 to 6 working days to the other delivery countries. For payment methods where we receive payment in advance (for example credit card, PayPal), the delivery period begins on the day after receipt of payment; for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(4) Partial deliveries are permitted insofar as this is reasonable for you, for example if individual items are temporarily unavailable. Partial deliveries do not incur any additional shipping costs for you.

(5) Should an ordered item not be available, we will inform you without undue delay. In that case we will refund any payments already made without undue delay.

(6) If goods are delivered with obvious transport damage, please report such damage to the carrier immediately if possible and contact us promptly. Failing to make such a complaint or to contact us has no consequences for your statutory claims, in particular your warranty rights. However, it helps us to assert our own claims against the transport company.

(7) The risk of accidental loss and accidental deterioration of the goods passes to you when the goods are handed over to you or to a person designated by you.

Section 7 Retention of title

The delivered goods remain our property until the purchase price has been paid in full.

Section 8 Right of withdrawal

(1) Consumers have a statutory right of withdrawal for distance contracts. The details, in particular the conditions, the withdrawal period, the consequences of withdrawal and the model withdrawal form, can be found in our right of withdrawal.

(2) The withdrawal instructions are also sent to you by email with the order confirmation.

Section 9 Warranty

(1) The statutory provisions on liability for defects (sections 434 et seq. BGB) apply to defects in the delivered goods. In the case of defective goods you are in particular entitled to subsequent performance (repair or replacement delivery) as well as, under the statutory conditions, to a reduction of the purchase price or withdrawal from the contract and, where applicable, to damages.

(2) The limitation period for claims for defects in new goods is two years from delivery of the goods.

(3) We do not provide any guarantees going beyond the statutory liability for defects (guarantees of quality or durability). Any manufacturer guarantees remain unaffected.

Section 10 Liability

(1) We are liable without limitation for damage arising from injury to life, body or health based on an intentional or negligent breach of duty by us, our legal representatives or our vicarious agents, as well as for other damage based on intent or gross negligence. We are likewise liable without limitation in the event of fraudulent concealment of a defect, assumption of a guarantee and under the German Product Liability Act.

(2) In the event of a slightly negligent breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract.

(3) Otherwise, liability for damage caused by slight negligence is excluded.

(4) The above provisions also apply for the benefit of our legal representatives and vicarious agents.

Section 11 Dispute resolution

(1) Information pursuant to section 36 of the German Consumer Dispute Resolution Act (VSBG): we are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Section 12 Final provisions

(1) The law of the Federal Republic of Germany applies to contracts between you and us, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If your habitual residence is in another member state of the European Union, the mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected by this choice of law.

(3) Should individual provisions of these terms be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
